Hey dudes. I ship out on July 24th. I got busted the other week for having a concealed weapon on me. It was a k-bar. We were just going to have some dumb drunk fun and cut down part of a palm tree in front of a sorority. UCSB is crawling with cops so of course I get stopped 20 feet from my house. The cops said I was compliant but that they had submit the case to the DA. Hopefully nothing happens and they just destroy the knife. If I do get a felony can I get a waiver for it or am I ****ed? I would appreciate if you would respond soon because this is really important. Also my recriuter said if I get a tattoo he'll kick me out of the Navy. Is that a legitimate threat?

NO. Felonies are NOT waiverable. As far as Tattoo's, you dont want to have a fresh one going into Boot camp. I hope you believe in God ~ you better start praying. I dont know if it would help but get a lawyer or talk to one quickly. See if talking with the DA BEFORE they make a decision whether or not to proceed with charges or not is a good idea. Maybe just going to talk to them and telling them you are going in the Navy and the circumstances...and hope again... to God they drop it.

GUYS - MAKE A HOLE ~ LISTEN UP

Just like Austin maybe you've signed on the dotted line, you've given yourself to Uncle Sam for a few years. So far you've been lucky, no big problems, the preliminary stuff you've passed and been approved to join the Military.

You and the guys go out to party and celebrate. HEY ~ I DID IT TOO. But, think about what you are doing, where you are, and who you are with. Think about EVERYTHING that is going on. Every move you make now can influence the rest of your life, just like it can when you are already IN the Navy.

You can have a great career, a Fantastic adventure awaits you. Dont put it in jeopardy. Austin found out, it can happen and it can happen FAST and for something that we use to call "Good ole boy S***". It dont fly anymore guys.

Please be careful BEFORE - DURING your enlistment. Especially if you will be required to have a security clearance. Trust me, you think they are not watching you? - they are. They are not going to put Secret or Top Secret information in the hands of people they cannot trust.

Austin, I REALLY hope this works out for you. Try what I suggested. Get in touch with the DA yourself if you cant afford a lawyer and tell them you are going in the Navy... it was stupid and all that good stuff. Basically throw yourself on their mercy. Thats the best you can hope for.

I'm sorry that you're in a situation, I've done stupid drunk stuff myself. But what are you doing with a k-bar anyway? I mean, carrying such a long fixed blade in an area hot enough to have palm trees? Aren't you worried about it printing? California doesn't necessarily have the most lenient carry laws.

Its been my dream to be a SEAL for 6 years. All those thousands of hours of training. All gone because I was going to cut down a plant. Well there is no way in hell I am going down without a fight. Thanks guys.

Felony you won't be allowed in the Navy either. When the case goes down and you have a chance, tell the judge whats up. He may give lenicy and break it down to a misdemeanor (http://www.google.com/search?hl=en&rlz=1T4DMUS_enUS263US264&sa=X&oi=spell&resnum=0&ct=result&cd=1&q=misdemeanor&spell=1). Show major regret. That will be your only chance. If you don't tell the Navy, they will discharge you anyways. Good luck.

Austin, send me your private email information to this site email or to conexxions3@aol.com I have an idea, there may be something I can do to help ~ but just this once. Even then I dont know if it will help or not but it's worth a shot.

In the email I want you to tell me "Exactly" what you did - and exactly what went down. Need the information on the city where you live that the case would be prosecuted. Now, IF it works, after this you better keep your nose clean or I will get on a plane find you put my foot up your butt so far my toes will be coming out your nose... understand?

Felony's can be waivered, but its a case by case basis and pretty rare in most districts. If its any type of violent crime it will not be waivered. They will look at others and make a determination though. It also depends on the Recruiting District, the Navy isn't allowed many waivers for it. We had a guy who couldn't get in through Los Angeles, but we sent him to another district and he was able to join there. He was in a similar situation, made a stupid mistake and didn't hurt anyone.

Obviously you won't be able to be a SEAL when you join with a felony, you'd be lucky if you were in even able to make it in the Navy. Try to talk to the DA and explain everything like oldswabbie said, thats your best bet.

I hate to disagree with you but most jobs in the military now require a secret clearance. YOU WILL NOT get one with a felony. You can with a misdoneanor. Felony NEVER. There is no waiver for a clearance.

I hear ya Mike but now after 9/11 things have changed. Felonies are even effecting all jobs related to the military. EVERYTHING seems to have gone secret because of 9/11. The Al Quada ****heads got thier intell from unsecured information site. Now, make it all secret makes it all harder to access. Besides, I don't want to be working with a felon. Its a trust issue.

I hope this kid Austin figures it out. Its in the DA's hands now.

Did your recruiter write that Letter and/or have you heard anything from the DA yet? I haven't heard anything either (I really didnt expect to anyway). I would expect she or her office will contact you and let you know whats the deal is. I am hoping Maybe, just maybe some community service and nothing else - I'm Hoping.

If you have a felony there are a couple things you can do to not get around it but maybe just over over looked. first of all if your wanting to go Seals you need to get a hold of your Govener and local Congressman. If you some how could get ahold of a Senator that would also look amazing. Give them a long extention of things you've done with yourself such as grades/college transcripts, write a paper of 'why the seals'(and how much you love this country) and all accomplishments throught out your life. If your foreal about it, after a couple years in the Navy they now have seen your work ethics and the way you conduct yourself and now they have a reason to trust you. You could get a high ranking officer to help get you into the program. And most of all, never take no for an answer or quit. Hoo Yaa

I agree with Mr. Parker - I will say again... a "seal" is a Cute furry little critter which is found in water and eats raw fish. A SEAL - is NOT a cute furry little critter (ok, they could be furry). However, they are often found in water with an unusually high volume of firepower in their hands. However, they only eat raw fish when its All you can Eat Sushi Night at Uncle Ho's Seafood Palace.

Remember - US Navy SEALS - not seals.

Austin just got in touch with me. The DA has lowered charges to Misdeameanor, now he has an attorney to get the rest of it taken care of. He's going to court this Friday and will let me know how things turn out. Hopefully they will take into account the fact he has no criminal record and is already signed up to go in the Navy to serve his Country.

Austin is a Good Guy ~ He just made a dumb mistake, something I wouldnt categorize as a crime at all. However, the State and County does.

Please be careful Guys, your future depends on what you do TODAY.

Does anyone know about felonies commited as a juvenile? as far as i know i can have the record placed on "Restricted access" but i worry that it will still interfere with the process of getting to bud/s.

Damn, CA is ****ed up, I carry weapons with me all the time, including firearms in FL, glad I don't live up there......

To the OP, the CJS is a big ****ing joke, just get a good lawyer and do whatever they tell you to do and you'll probably get it dismissed.

This is the same CJS that will give a girl who got into a crash while DUI, resulting in her friends death 4 years in jail even though she is remorseful, took lots of actions and was against drinking and driving gave speeches etc....while Nick Bollea(Hulk Hogans son) does the SXT and doesn't kill but turns his friend into a vegetable, who is a Marine and is not remorseful and said "he was a negative person, I wanna make a show about this and make a lot of money out of it" after making his friend a vegetable, and a gang member who killed a pizza delivery guy will get 5 years only, one year more than the DUI girl, for second degree murder......that's the CJS, I study CJ and it's a ****ing joke, get a lawyer dude, pay a lot of money for a good one, and you'll get an OJ outcome.

It DOES matter. Records are available to the government no matter what, when, where they occurred. Even the judge says they are sealed - not to the US Government when they come searching for a security clearance.

It is illegal for any convicted felon to carry a firearm.

Forget about the clearance level, unless you are going to do something that won't ever put you in any chance of being near a firearm, forget about any military career.

Avoid breaking the law, especially if it could be a felony.

Out of an estimated 42 million felonies commited annually, only 419,500 people are sent to prison each year. (BJS, CJ statistics 2003 DC, NIJ, includes drug crimes)

But then again, you don't need to commit a crime to get arrested, you can get arrested any time for almost anything, as long as the hearsay exists.

Well I just got the news this morning. The judge officially dismissed the case! It is now an infraction for disturbing the peace by being too loud. I cannot even describe how relieved I am. Those few weeks were so rough. I thought everything I have worked for and become over the past 6 years was going to be for nothing. But now I'm back baby! I just wanted to thank you guys for your support, especially you oldswabbie. I'll definitely be toning it down from now on. I don't think I can take another situation like that. Ha ha ha. I am so pumped. I'm going to go tear it up on a run. Thanks again dudes.

I just opened my browser and saw the thread "Felony" and i got a chill. I stopped and said .. Lord, Please.. let it be GOOD NEWS. You may not believe this, I've actually got tears running down my face I'm so happy. This was a close call. You almost lost everthing you had worked so hard for.

YOU MADE MY DAY AUSTIN!! YOU MADE MY DAY! Now, you can go on with your Naval Career and have a WONDERFUL time in bud/s and as a Navy SEAL. I have faith in you!

I never heard anymore back from Austin.. I guess he shipped out on the 24th of July for Boot. If anyone in Great Lakes pre-bud/s runs into him let me know how he's doing! And tell him I STILL believe in him!

He still has his SEAL contract, that means he will be a winter Bud/s class.. OH buddy..
